AB 411/SB 321: Undermining Wildlife Protection

Wisconsin’s wildlife belongs to all citizens of our state. Department of Natural Resources (DNR) wardens are charged with ensuring these shared resources are protected. A long established “Open Field Doctrine” allows law enforcement to look for and enforce the law in open areas on private land, which is a different privacy standard than citizens can expect in their homes and buildings. AB 411 & SB 321 would prohibit DNR wardens from enforcing penalties for violations against a public resource.
AB 411 was introduced and referred to the Assembly Natural Resources and Sporting Heritage Committee. The bill had a public hearing on July 19, 2017. It is now available to be scheduled for a vote. SB 321 was introduced and referred to the Senate Natural Resources Committee. The bill died at the end of the session.
